I have a new claim and need to use a private 10 house subdivision road to get to my land locked claim.

Any ideas of my best choices to get access, I checked and the forest service does not have an easement to the land either.

If the road owners are not receptive to my  using  the road I read you can get a court to give egress (has anyone done this?) Don't laugh but do you think the USFS would help to get an easement?

Any ideas will help.

  • depends on the legal ownership of the road.  Is it owed by the city, the county, the state or the HOA?

  • sounds like you only have to cross one property to get to your claim. shouldn't be to hard to make a deal with one family. i access a private road in the fall to hunt .I asked the owner what it would take let him set the deal himself and went from there. If you can use power equipment on your claim i'd keep the noise between 9am and 5pm  have a BBQ on your claim and invite them over. durant had the right idea with a goodie package. hell get inventive

  • I made a deal with a land owner to help maintain his road (clearing debris from winter tree falls and left him the wood) and the claim road during my claim access road maintenace. Gave him a pt. of Wild Goose Berry jam to sweenten the deal. ;)

    Tit for tat....

    • You make sure that it's WILD Goose Berries...none of that store bought junk or the deal wont work.

  • The FS can not deny you access to a claim. but they won't buy you access either. The roads in a subdivision are semi-public, by that I mean that the roads aren't maintained by the county, state, or city, but they have to allow access for meter readers, maintainance people, etc. So I think your best bet is to contact the person closes to where you are going to access your claim, and let him know what you are doing. If he (they) don't have a problem, then you are good to go. I see you are from ID. When I lived there, I found the people to be friendly if you approached them right. Good luck.   Ted

  • What I would do is talk to all the people thereand fill it out and if you hunt take some sausage with you and give it to them if they would like some and if you get to use the road and when you go to your claim stop and show them what you are getting and talk more they may get the gump and try it for them self. You may invite them along and show them a little you may be suprize.
