    atented claims are private property and you own the land. There are restrictions but You can build if local zoning approves it. In many areas there are little zoning laws so it's easier to build what you want. You may still need state permits for major soil disturbance, altering water courses etc. Unpatented mining claims are on federal property and You are buying or leasing mineral rights only. You don't own the property and in fact anyone can camp, hunt, or recreate on your claim. They cannot remove minerals, which is reserved for you only. There are many restrictions on these claims, especially if they are located within a national forest. The national forest rangers can shut down a claim in a heart beat, even close an entire area to mining for years, like they did in ariz. south of prescott in the prescott nat. forest. In south dakota where I live the nat. forest rangers shut down all claims along a creek in the black hills nat. forest, one owned by a friend of mine. JB

  • eric none patented claims you only own the mineral rights  patented claims you own both the land and the mineral rights and if you can get the permits to build a cabin you can do it but its getting harder t get the permits to do anything on any type of claim
