I have a newbie question concerning claims and my research on the Google machine has not provided me with a definite answer. My question:
If some has a lode claim does that prohibit prospecting for placer gold by anyone not on the lode claim?
This situation is there is a creek that looks like it'll be a nice shady area to explore once it warms up out here in a month or so. There are 2 lode claims in the section but neither appear to be anywhere near the creek if I'm reading the BLM papers correctly. I don't expect any issues but in case there are I want to make sure I'm not "claim jumping" someone else territory.

smart move allen not the hassel l0de claims can have a lot of tunnelsand areas of lode deposits
Allen I've always held to Ken's view but there is an opposing view that Load only covers load and that you can file placer over it, and vis-versa, as long as you stay away from the load entrance or stockpiles but if you go that route you'd be wise to have your lawyer on speed dial, and a good sidearm on your hip
Thanks Talon, I'm just a recreational prospector so it's not worth it to me to get into any kind of fight. I plan on contacting the load claim owners to make sure it is not near their claim before going up there.
depends on how much valuable content the claim owner has removed and what he thinks and feels its worth as a resale item
There are sites on the web that have claims for sale and I've found some good claims even on Craig's list and Ebay. A wealth of information can be obtained by talking to the local population and mining clubs.
If you don't know how to locate a claim be cautious buying one. being able to research the paperwork. is important.

your gonna have to go to the county and look uo the claim location recording it should have a map and description of the claims. A full size lode claim can be 20.66 acres.
You can not file a placer around or over a lode claim and do not have the right to prospect on the lode claim for placer.
