Well I was going to Oregon to dredge my partners claim but it seems that Oregon no longer has a valid permit for dredging, when are these people going to pass out from lack of air due to the fact their heads are stuck so far up their a**. I guess we are forced to be outlaws, well those that depend on this occupation as a means of survival, although according to the farce of a government we have, we are all recrerational, the people who mine small scale for a living, meager at that, don't exsist.I might just pack my self very deep in the hills were they will have to work real hard while watching for falling rocks to hassle me.

  • Check out whats happening in Oregon,   they need your help !!!    This kind of micromanaging and restricting open access has killed small recreational mining in CA !    Next is Oregon then YOUR STATE!!!!

      is there a technical description for recreational miners on the state books? as far as the mining laws go there aint none

  • Someone has posted on another forum, that they were going to send in a request to "The Oregon Dept. of Environmental Quality" for a refund for the permit fees for the last 5 years that he has paid for the "invalid" 700PM permit.

    I think that this a GREAT idea and encourage all of you that have paid for the 700PM permit in the last 5 years to do the same!!

  • I have been reading about this on several forums, and from what I been reading there are two different dredging permits that you had to have in Oregon, one is issued by the State of Oregon, and is not affected by this decision by the court and the other which is affected and is no longer valid unless an appeal changes things, one issued by " The Oregon Dept. of Environmental Quality" and is/was called 700PM permit.

    Several longtime dredgers who live in Oregon said that they have never gotten/ or refused to get the 700PM permit since it was enacted in 2005, and have stated that they will be dredging in 2010 with only the state permit.

    So from what I have been reading you should be able to dredge in Oregon with just the State permit, but it is up to you to know for sure, just don't take what I have posted and go dredging in 2010.

    " IMPORTANT NOTICE TO ALL OREGON SUCTION DREDGE MINERS:

    On December 23, 2009, the Oregon Court of Appeals finally issued a ruling regarding the Oregon Suction Dredge Mining Permit (700-PM); declaring the permit INVALID.

    BACKGROUND: The Oregon Dept. of Environmental Quality issued the new 700-PM Suction Dredge Mining General Permit in July of 2005. In August ’05, a coalition of environmental orgs (NEDC et al.) filed challenges to the new permit, claiming among other things, that the new permit was not restrictive enough (after-all, the new permit did in fact allow suction dredge mining).

    In the fall of ’05, the Eastern Oregon Mining Association (EOMA), with the help and support of the Waldo Mining District, Willamette Valley Miners, and other mining orgs, filed to intervene in the NEDC challenge, and filed a challenge of their own against the permit (the EOMA challenge claimed the 700-PM permit was the wrong permit (being issued as a “NPDES” permit pursuant to Section 402 of the Clean Water Act (CWA) for the EPA instead of a “non-NPDES” permit pursuant to Section 404 of the CWA through the Army Corps.))

    Unfortunately, although the Oregon court declared the 700-PM permit invalid, they did not clearly rule which, if any, permit was actually required (i.e.; Sec. 402 or sec. 404 of the CWA, or neither). Parties in this case have been given 2-3 weeks to file appeals for clarification.

    So, at this time, Oregon suction dredge miners are in the same boat as California suction dredge miners in that the law says a permit is (or may be) required, and yet no permit is available . . . and it is unlikely that any permit will be available by summer of 2010.

    EOMA is planning to appeal or request clarification of the ruling. They need the support of the Oregon suction dredge mining community. Although not as expensive as the preliminary challenge and intervention, any appeal will none-the-less cost minimally several thousands of dollars.
