What is the Best way to write out a Plan of Opperation for a Lode Claim ? Are there some things to say and some thing not to say ? Water Rights ? Transporting of Ore ? Tailings ? Camp ? Can a backhoe be used ? What is considered "Topping a Hill" ? Would like to Cut a Vain out the Side of a hill and move the Ore to Privet Property.

Spur: If you can find the old records at the Recorders Office or with the BLM and the have the written legal description of the old claim, then you have a head start. Next, would be trying to locate the old corners of the claim. The legal description should help doing that. If you can find the old claim markers then you may be able to use that information to update the claim to give you ownership of it. When you find the old corners, remark them and get their GPS location for your records. At that point you can check with the recorder and see if they will let you overfile on the claim. You have to jump through all of their hoops to get it done. Good Luck. Dickb
Dennis: I don't know why you would have to hire a survey crew to stake a load claim. You are right about the size of the claim (1500 x 600ft), but you can stake that out yourself. Put a location notice up at your point of discovery, then put up your corner posts. Things might have changed, but back in the 70s and 80s, I use to go to the local court house, and the claims were in the recorders office, on a plat of the section # and township and range. The only time you would need to survey the claim, is if you were applying for a patent on the claim. Ted
spur i think you will have to go to the blm rigenal office to get the maps not the county recorders office if its not a patented claim
Thanks Richard If I read that Right I should be able to go tothe Recorders office and find old Maps to closed claims this will give me a Free Heads-up on as to where I can Point a Survey Crew and save some money. I now see what Howards was saying "Get My CheckBook"

Yes, you will have to pay for the survey, recording and maintenance fees, but what you will recieve is a quit claim deed to the claim. That means that it now belongs to you and you have the mineral rights to the claim. If you patent it, then you also own the land as well. Then if the government wants to take possession of the land under the law, they have to pay you a fair price for you property. The big plus for you is that whatever is on the land legally belongs to you, and you can stop other folks from claim jumping. Dickb

I'll add to what APerfectCure just said. Yes you need to get a survey done by a proffessional surveyor. He will locate the corners of the claim and place permanent reference points, then he will write a report that gives the legal description of the claim which you take to the County Recorder to record the deed. The County will accept his sealed document as correct. Then you still have to go out and mark the claim as stated by the Feds. It does cost you money to do that but you get a valid claim to the mine that can't be disputed by others. I hope this helps you some. Dickb
